Course information

This course will be delivered virtually via MS Teams.

This course aims to provide delegates with safeguarding legal training and is relevant for practitioners working to safeguard adults and children.

Whilst this course will be relevant to all professionals and their managers who work directly with children and young people and/or their parents or carers and adults at risk to assist in understanding consent, capacity, and information sharing, much of the case law and therefore examples provided are specific to health.  

The principles of this training are applicable to all professionals working within safeguarding, and learning from these health examples can be extrapolated to all agencies.

This session will be delivered by Bevan Brittan LLP.

Target group

This course will be relevant to all professionals and their managers who work directly with children/young people and/or their parents/carers and vulnerable adults/adults at risk to assist in understanding consent, capacity and information sharing.

Aims and objectives

  • To understand the legal requirements for consent
  • To be able to explain Gillick competence
  • To understand capacity under the Mental Capacity Act 2005:
    • to explore who should assess capacity
    • to demonstrate appropriate preparation for assessing capacity
    • to identify the “relevant information” for assessing capacity
    • to understand fluctuating capacity
  • To understand the potential limitations of the presumption of capacity and positive duties to undertake capacity assessments
  • To be able to identify key principles in information sharing for safeguarding.

Please note: Delegates should attend this module before attending Legal Training 2 – Best interest decisions, self-neglect and liberty protection safeguards.
